Terms of Use

NutriScan is a consumer wellness and packaged-food guidance product. These Terms of Use explain the product scope, the limits of the guidance, what you are responsible for when using the app, and how risk and liability are allocated as far as applicable law allows.

Service scope and intended use

The service is intended for informational wellness support in consumer food-selection contexts. NutriScan summarizes packaged-food information, product databases, OCR output, and profile-aware analysis so users can make more informed nutrition decisions. It is not sold or presented as a physician service, diagnostic tool, emergency triage system, insurance decision system, or regulatory certification engine.

No medical, dietetic, or emergency advice

NutriScan does not provide medical advice, diagnosis, treatment, emergency support, allergen guarantees, or individualized clinical nutrition planning. If you have pregnancy-related concerns, kidney disease, diabetes, severe allergies, eating-disorder history, medically prescribed diets, or any urgent or high-risk condition, you should use qualified clinical judgment and professional care rather than relying on the app alone.

Eligibility and account responsibility

  • You are responsible for keeping your login credentials secure and for activity that occurs through your account unless applicable law provides otherwise.

  • You should use an email account you control and keep it current so account, privacy, and security notices can reach you.

  • If you use the app for another person, including a child or dependent, you are responsible for ensuring that you are authorized to do so and that the profile information you enter is accurate and lawfully provided.

Your responsibilities when using the guidance

  • Keep your profile accurate and current.

  • Review OCR output before relying on a scan result.

  • Read the actual product package, ingredient list, and allergy warnings when available rather than relying only on the app summary.

  • Use professional guidance for pregnancy, kidney disease, diabetes, allergies, or any high-risk medical condition.

  • Do not treat a score, badge, warning, or recommendation as a guarantee that a product is safe, clinically appropriate, or free from allergens or formulation changes.

Product, OCR, and database limitations

Nutrition labels, ingredients, serving sizes, formulas, and health claims can change at any time. OCR can misread text, product databases can be incomplete or stale, barcodes can resolve to the wrong regional variant, and some nutrients important for specific health conditions may be absent from retail labels entirely. You agree that packaged-food decisions still require your own judgment and, where appropriate, direct verification from the manufacturer or a clinician.

AI-supported analysis and experimental features

Some NutriScan outputs are generated or shaped by automated systems, including OCR and AI-supported analysis. Those systems can produce inaccurate, incomplete, inconsistent, or overly generalized results. Features described as preview, beta, experimental, or newly launched may be especially volatile and can change without preserving exact prior behavior, phrasing, or output structure.

Third-party services and external content

The app may depend on third-party authentication, cloud hosting, barcode databases, nutrition sources, OCR infrastructure, AI services, operating-system permissions, and device share flows. We do not control all third-party systems and cannot guarantee their uptime, accuracy, security posture, regional availability, or ongoing compatibility with the app. Links to external sources or references are provided for convenience and context, not as an endorsement of every statement on those external sites.

Brand names, product images, and nominative use

NutriScan may display third-party brand names, package images, logos, and product references only to identify the product a user scanned, searched, saved, or reviewed. Their appearance is descriptive and does not mean the brand owner sponsors, endorses, certifies, or partners with NutriScan. Marketing materials, screenshots, store assets, and promotional copy should avoid implying a commercial relationship with any brand unless that relationship actually exists and is clearly authorized.

Availability, modifications, and continuity

App features may change, improve, pause, or be removed as the product evolves. Some controls, exports, privacy tools, and integrations may appear in the interface before they are fully available in every region, build, or platform version. We may update scoring logic, policy text, routing, design, provider integrations, and feature boundaries without guaranteeing that any specific feature will remain available indefinitely.

Acceptable use

  • Do not attempt to misuse the service, scrape protected account data, or interfere with system reliability.

  • Do not represent NutriScan outputs as a medical prescription or regulatory certification.

  • Do not use the app to create misleading health claims, impersonate another person, test unauthorized access, or harvest data from other users.

  • Do not upload content you do not have the right to use, including product images or label material captured in a way that violates applicable law or third-party rights.

Suspension, restriction, and termination

We may suspend, restrict, or terminate access where reasonably necessary to protect the service, investigate abuse, respond to legal process, address security issues, or enforce these Terms. You may stop using the service at any time, but some data may continue to be retained for the periods and reasons described in the Privacy Policy, including security, backup, and legal compliance needs.

No warranties

To the fullest extent permitted by applicable law, NutriScan is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, perfectly secure, clinically appropriate for your needs, or free from OCR mistakes, stale database results, model drift, or packaging mismatches. We also do not warrant that every product, ingredient, nutrient, allergen, or condition-specific issue will be detected or described correctly.

Limitation of liability

To the fullest extent permitted by applicable law, NutriScan and its operators, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, goodwill, or expected savings arising out of or related to the service. Where the law allows limitation but not full exclusion, liability should be limited to the minimum extent necessary to provide the service while respecting non-waivable rights. Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded, such as certain rights under mandatory consumer-protection law.

Indemnity and misuse-related losses

To the extent permitted by law, you agree to be responsible for losses, claims, or costs arising from your misuse of the service, your violation of these Terms, your infringement of another party’s rights, or your unlawful submission of content or data through the app. This provision should be interpreted narrowly where local law restricts indemnity obligations for consumer services.

Consumer-law and regional carveouts

These Terms are meant to apply broadly across North American consumer contexts, but some jurisdictions do not allow certain warranty disclaimers, liability exclusions, indemnity provisions, or contractual waivers. Where mandatory local law gives you stronger rights, those rights continue to apply and control over conflicting portions of these Terms to the extent required by law. Nothing here is intended to remove non-waivable privacy, consumer-health, or consumer-protection rights that applicable law preserves.

Policy, standards, and privacy documents

These Terms should be read together with the Privacy Policy and Data Standards & Sources pages because they explain how your information is handled and what source and methodology limits affect the guidance. If those documents describe additional restrictions, safeguards, or limitations, they form part of the broader user understanding for the service.

Updates to these terms

We may revise these Terms as the product, feature set, data sources, provider stack, and legal environment evolve. When changes are material, we may update the date shown above and may provide in-app notice or another reasonable notice method before the revised terms apply.
